Terms of Service

By downloading, installing, or using Oarsum, you agree to these Terms of Service, the Privacy Policy, and the Safety & Disclaimer.

1. Acceptance of terms

If you do not agree, do not use the app. If you are under 13 years of age, do not use Oarsum. Older minors may use Oarsum only with permission and supervision from a parent or legal guardian when local law requires it.

2. Description of service

Oarsum is a recreational GPS tracking and paddle sports logging application for iPhone and Apple Watch. It supports route tracking, distance, speed, elapsed time, HealthKit-powered fitness metrics when permitted, local session history, Live Activities, and related paddle statistics.

Oarsum is a recreational tracking tool only. It is not a safety device, navigation system, emergency communication tool, or medical monitoring device.

3. User responsibilities

  • You are responsible for your own safety and the safety of anyone with you.
  • You must comply with applicable boating, waterway, and local access rules.
  • Do not interact with the app while actively operating your watercraft.
  • Do not rely on Oarsum as your sole means of navigation.
  • Do not misuse, reverse engineer, modify, decompile, or redistribute the app.

4. Assumption of risk

Kayaking, canoeing, stand-up paddleboarding, and all paddle sports carry inherent risks, including drowning, hypothermia, capsizing, collision, physical injury, and death. GPS, battery, sensor, and network failures can occur without warning. Oarsum is not connected to emergency services and cannot summon help on your behalf.

5. Limitation of liability

Oarsum is provided "as is" and "as available" without warranty of any kind. To the fullest extent permitted by law, the developer is not liable for personal injury, death, property damage, data loss, device damage, inaccurate GPS or health data, or direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use Oarsum.

6. Health data

Oarsum integrates with Apple Health with your permission. Health and fitness data shown in Oarsum is informational only, is not medical-grade, is not medical advice, and should not be used to diagnose, treat, monitor, or manage any medical condition.

Raw Apple Health records stay on your device. Oarsum does not upload heart-rate samples or raw Apple Health records. Optional analytics may upload daily workout count and active-energy totals as described in the Privacy Policy.

7. Intellectual property

All intellectual property in Oarsum, including the Oarsum name, app icon, logo, Balmo mascot, design, code, and developer-created content, is owned by Eric Shine and protected by applicable law. You receive a limited, non-exclusive, non-transferable, revocable license to use Oarsum on Apple devices you own or control for personal recreational purposes.

8. Your data

Trip data, routes, session logs, and statistics you create in Oarsum belong to you. Oarsum is local-first: app data is stored locally on your device using Apple's SwiftData framework. No trip data is transmitted to external servers without your explicit action, such as exporting, sharing, enabling an optional sharing feature, or attaching route points to a support report. The Privacy Policy governs Oarsum data handling in detail.

9. Oarsum+ subscriptions

Core paddle recording, routes, duration, distance, heart rate, calories, and local trip history are available without a subscription or account.

Oarsum+ is an optional auto-renewable subscription that unlocks premium Oarsum-calculated features, including advanced aggregate stats, Paddle Intelligence, records, trends, patterns, efficiency analysis, and GPX export after your included free GPX export.

Prices, currency, taxes, and availability are shown in the App Store before purchase and may vary by country or region. Oarsum+ renews automatically unless cancelled through your Apple ID account settings at least 24 hours before the current period ends. Apple processes all purchases, billing, renewal, cancellation, and refunds through the App Store. The developer does not have access to your payment information.

10. Termination

The developer may terminate or suspend access to Oarsum if you violate these terms, misuse the app, or engage in harmful, fraudulent, or abusive conduct. You may stop using Oarsum at any time by deleting the app. Uninstalling removes locally stored data on that device.

11. Updates to these terms

The developer may update these terms from time to time. When changes are made, the effective date will be updated. Continued use of Oarsum after an update constitutes acceptance of the revised terms.

12. Governing law

These terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Nothing in this section limits mandatory consumer protection rights that apply in your country of residence.
